Liability Waiver

RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS AND INDEMNITY AGREEMENT

This Agreement is entered into between the signing party ("Participant" or "Guardian") and Capital Blasters and its owners, operators, employees, agents, representatives, successors, and assigns (collectively "Capital Blasters").

1. DESCRIPTION OF ACTIVITY

The activity involves organised foam dart tag battles using foam dart blasters, inflatable barricades, and related equipment (the "Activity"). Events are hosted at various outdoor and indoor locations in and around Ottawa, Ontario, Canada, as arranged by Capital Blasters.

2. ACKNOWLEDGMENT OF RISKS

I am aware that participation in the Activity involves inherent risks, hazards, and dangers that cannot be eliminated, including but not limited to:

• Being struck by foam projectiles, including to the face, eyes, or body
• Physical contact with inflatable barricades, field obstacles, and other equipment
• Contact with other participants during play
• Trips, slips, falls, and collisions on grass, pavement, or uneven terrain
• Physical exertion and overheating in warm weather conditions
• Eye irritation or injury despite the use of protective goggles
• Pre-existing medical conditions aggravated by physical activity

I voluntarily and freely assume all of the above risks and accept personal responsibility for any loss, damage, or injury that may result.

3. RELEASE OF LIABILITY

In consideration of being permitted to participate in the Activity, I, on behalf of myself and my heirs, executors, administrators, personal representatives, and assigns, hereby release, waive, discharge, and covenant not to sue Capital Blasters from any and all liability, claims, demands, actions, and causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by me or any minor in my care, whether caused by the negligence of Capital Blasters, its employees or agents, or otherwise.

4. INDEMNIFICATION

I agree to defend, indemnify, and hold harmless Capital Blasters from and against any and all claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or resulting from my participation in the Activity, or the participation of any minor for whom I am signing, including any injury or damage caused by me or that minor to third parties or to property.

5. EQUIPMENT RESPONSIBILITY

I agree to use all provided equipment responsibly and in strict accordance with the instructions given by Capital Blasters staff. I accept full financial responsibility for any equipment that is lost, damaged beyond normal wear, or not returned at the conclusion of the event, and I agree to pay the full replacement or repair cost upon request.

6. MEDICAL FITNESS

I declare that I (and any minor participants listed below) am medically fit to participate in vigorous physical activity and am not aware of any condition that would prevent safe participation. I acknowledge that Capital Blasters does not provide medical supervision and that I am solely responsible for disclosing any relevant medical information prior to participation.

7. PARTICIPANTS UNDER 18 YEARS OF AGE

If I am signing on behalf of a minor or minors, I confirm that:

• I am the parent or legal guardian of each minor listed in this waiver
• I have full legal authority to sign this Agreement on their behalf
• I assume all obligations, risks, and responsibilities described in this Agreement on behalf of each minor
• I have read this Agreement carefully and consent to each minor's participation in the Activity

8. PHOTO AND MEDIA CONSENT

I grant Capital Blasters a non-exclusive, royalty-free licence to use photographs, video recordings, and other media of me (and any minors in my care) taken during the Activity for promotional, marketing, and social media purposes. I may opt out of this consent by indicating below.

9. SEVERABILITY

If any provision of this Agreement is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect.

10. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada. Any dispute arising from this Agreement shall be subject to the exclusive jurisdiction of the courts of Ontario.

11. ELECTRONIC SIGNATURE

I agree and acknowledge that my electronic signature below, affixed by me personally, constitutes a valid and binding signature with the same legal effect as a handwritten signature, pursuant to applicable electronic commerce legislation.

I HAVE READ THIS AGREEMENT CAREFULLY AND IN FULL. I UNDERSTAND THAT IT IS A RELEASE OF LIABILITY AND WAIVER OF CLAIMS. I AGREE TO ALL OF ITS TERMS FREELY AND VOLUNTARILY.
